First, what is special equipment?
According to the definition of the Law on Safety of Special Equipment, special equipment refers to boilers, pressure vessels (including gas cylinders), pressure pipes, elevators, lifting machinery, passenger ropeways, large amusement facilities, special motor vehicles in yards (factories) (hereinafter referred to as "field vehicles") and other special equipment to which the Law on Safety of Special Equipment applies according to laws and administrative regulations.
2. Are there any specific requirements for the definition of special equipment?
(1) According to the Law on Safety of Special Equipment, the state implements catalogue management of special equipment. At present, whether a product belongs to special equipment is mainly defined according to the specific definition and description of the product structure, working parameters and product use in the annex to the Announcement of General Administration of Quality Supervision, Inspection and Quarantine on Revising the Catalogue of Special Equipment (formerly Announcement No.114 of General Administration of Quality Supervision, Inspection and Quarantine, 2014). The catalogue includes 157 4-digit special supervision codes for special equipment and its safety accessories. Among them, there are 6 codes for boilers, 19 codes for pressure vessels, 42 codes for pressure pipes, 15 codes for elevators, 35 codes for hoisting machinery, 10 codes for passenger ropeways, 21 codes for large-scale amusement facilities, 4 codes for yard cars and 5 codes for safety accessories.
(II) The Regulations on Safety Supervision of Special Equipment revised in 2009 also contains a basic description of special equipment. However, according to the requirements of Opinions of the General Administration of Quality Supervision, Inspection and Quarantine on Several Issues Concerning the Implementation of the Newly Revised Catalogue of Special Equipment (GQQ Special [2014] No.679), special equipment will be defined according to the description in the new Catalogue of Special Equipment from October 30, 2014.
3. What are the access and declaration requirements for imported special equipment?
Article 30 of the Law on Safety of Special Equipment stipulates that imported special equipment shall meet the requirements of China's safety technical specifications and pass the inspection; If it is necessary to obtain the production license of special equipment in China, it shall obtain the license. At the same time, its installation and maintenance instructions, product nameplates, safety warning signs and their descriptions shall be in Chinese.
At present, the supervision certificate of imported special equipment has been verified online. According to the Announcement of the General Administration of Market Supervision on Relevant Matters Concerning Administrative Licensing of Special Equipment (Announcement No.3 of the General Administration of Market Supervision in 2019), the imported pressure-bearing special equipment such as boilers, pressure vessels and pressure pipelines is in the form of license from the manufacturer/manufacturer, and the "overseas special equipment manufacturing license (customs code 430)" and the license number should be filled in when reporting. Imported electromechanical special equipment, such as elevators, cranes, passenger ropeways, large amusement facilities, parking lots, etc., and some components and key parts of pressure-bearing special equipment adopt the type test license method. When applying, the "Type Test Certificate for Imported Electromechanical Special Equipment (Customs Code 429)" shall be filled in, and the certificate number shall be filled in, and the product name shall be filled in according to the contents described in the corresponding certificate.
4. What are the special access requirements for imported special equipment?
Article 100 of the Special Equipment Safety Law stipulates that,
First, the Special Equipment Safety Law does not apply to the safety supervision and management of military equipment, nuclear facilities and special equipment used in aerospace vehicles.
Second, the supervision and management of the safety of railway locomotives, offshore facilities and ships, special equipment used underground in mines and special equipment for civil airports shall be implemented by the competent authorities in accordance with the Special Equipment Safety Law and other regulations.
Third, the supervision and management of the installation and use of lifting machinery used in housing construction sites and municipal engineering sites and special motor vehicles in the field (factory) shall be implemented by the relevant departments in accordance with the Law on Safety of Special Equipment and other regulations. In addition, temporary imported mobile pressure vessels, gas cylinders and special equipment not used in China also have corresponding regulatory requirements. 5. What are the regulatory requirements for importing special equipment?
(1) If the accessory parts of the equipment belong to special equipment, according to the Notice of the General Administration of Quality Supervision, Inspection and Quarantine on Adjusting the Inspection and Supervision of Import and Export Boilers, Pressure Vessels and Pressure Pipes (No.107 [2006] of the State Administration of Quality Supervision, Inspection and Quarantine), the relevant parts shall obtain the production/manufacturing license of China.
(2) If the imported product belongs to or comes with an accumulator, according to the Opinions on Relevant Issues Concerning the Management of Boiler and Pressure Vessel Manufacturing License (GQQ Special Letter [2005] No.203), it is only necessary to import the accumulator shell manufacturer to obtain the manufacturing license, but the name of the shell manufacturer and the license number must be indicated on the accumulator product.
(3) If the pressure piping components are imported with boilers and pressure vessels, according to the requirements of the Announcement of the General Administration of Quality Supervision, Inspection and Quarantine (formerly Announcement No.151 of the General Administration of Quality Supervision, Inspection and Quarantine, 2012), the above components shall be inspected for product safety performance with boilers and pressure vessels at the same time.
(4) If the imported special equipment belongs to used mechanical and electrical equipment, it is not allowed to be imported, such as in the Announcement of Relevant Matters Concerning the Adjustment of the Catalogue of Used Mechanical and Electrical Products Prohibited from Import (Announcement No.106 of the Ministry of Commerce and the General Administration of Customs in 2018). Other used special equipment that is allowed to be imported must obtain China's entry permit and be inspected before shipment according to regulations. If it belongs to non-road mobile machinery, it should also provide effective emission inspection reports and other supporting documents.
